Terms of Service

Effective Date: September 8, 2026

These Terms of Service (“Terms”) govern your use of the applicant tracking system (“ATS”) operated by Recon Managed Services, LLC (“Recon,” “we,” “us,” or “our”) in connection with applying for employment opportunities with Recon.

By accessing or using the ATS or submitting an employment application through it, you agree to these Terms.

If you do not agree to these Terms, you should not use the ATS or submit an application through it.

1. Purpose of the ATS

The ATS is provided for the limited purpose of allowing individuals to:

  • View or respond to employment opportunities with Recon
  • Submit employment applications
  • Provide résumés, cover letters, and related application materials
  • Receive communications regarding the status of an application
  • Participate in Recon's recruiting and hiring process

The ATS is not intended for any unrelated commercial, promotional, or personal purpose.

2. Eligibility

You must be at least 16 years of age to use the ATS or submit an employment application through it.

By submitting an application, you represent that you are at least 16 years old and legally permitted to apply for the applicable employment opportunity.

Certain positions may have additional age, licensing, work authorization, education, experience, or other eligibility requirements.

3. No Account Required

You are not required to create an account in order to submit an employment application through the ATS.

You are responsible for ensuring that the contact information you provide is accurate and current so that Recon can communicate with you regarding your application.

4. Application Information

When submitting an application, you agree to provide information that is accurate and complete to the best of your knowledge.

You agree not to knowingly submit:

  • False or misleading information
  • Fraudulent qualifications, credentials, or employment history
  • Information belonging to another person without authorization
  • Malicious files, software, or code
  • Content that is unlawful, threatening, abusive, defamatory, or otherwise inappropriate
  • Information that infringes the intellectual property, privacy, or other rights of another person

Recon may verify information contained in an application to the extent permitted by applicable law and appropriate for the applicable position.

Submitting false or materially misleading information may result in removal from consideration for employment or other appropriate action.

5. Application Materials

You retain ownership of the materials you submit through the ATS, including your résumé and cover letter.

By submitting application materials, you grant Recon permission to access, review, copy, store, and use those materials for recruiting, hiring, employment-selection, legal compliance, and related recordkeeping purposes.

This permission continues for as long as Recon lawfully retains your application information.

You represent that you have the right to submit the materials included with your application and that Recon's use of those materials for recruiting and hiring purposes will not violate the rights of another person.

6. No Guarantee of Employment

Submission of an application does not:

  • Guarantee an interview
  • Guarantee consideration for any particular position
  • Guarantee an employment offer
  • Create an employment relationship
  • Create an employment contract
  • Require Recon to keep a position open
  • Require Recon to provide a reason for a hiring decision, except where required by applicable law

Recon may modify, suspend, close, cancel, or fill a position at any time, subject to applicable law.

Recon reserves the right to determine which applicants will proceed through the recruiting and hiring process.

7. No Employment Contract

Nothing contained in the ATS, a job posting, an application, an email communication, or these Terms creates a contract of employment or a promise of employment.

If you are offered employment, the terms and conditions of that employment will be governed by the applicable offer documents, employment policies, agreements, and applicable law.

Nothing in these Terms alters the nature of any employment relationship that may later be established between you and Recon.

8. Communications

By submitting an application, you authorize Recon to contact you at the email address you provide regarding:

  • Confirmation of your application
  • Application status updates
  • Interview scheduling
  • Requests for additional information
  • Employment-related opportunities associated with your application
  • Other recruiting or hiring communications

Recon does not use applicant contact information through the ATS for unrelated advertising or promotional marketing.

Email communications may be delivered using third-party service providers, including Resend.

You are responsible for ensuring that the email address you provide is accurate and capable of receiving communications from Recon.

9. Acceptable Use

You may use the ATS only for lawful employment-application purposes.

You may not:

  • Attempt to gain unauthorized access to the ATS or its underlying systems
  • Attempt to access another applicant's information
  • Probe, scan, or test the vulnerability of the ATS without written authorization
  • Circumvent or attempt to circumvent security controls
  • Introduce malware, viruses, malicious code, or other harmful material
  • Interfere with or disrupt the operation of the ATS
  • Use automated tools, bots, scrapers, or similar technology to access or extract information from the ATS without authorization
  • Attempt to reverse engineer or improperly copy the ATS
  • Use the ATS in violation of applicable law
  • Misrepresent your identity or impersonate another person

Recon may restrict or block access to the ATS when reasonably necessary to protect the security, integrity, availability, or lawful operation of the system.

10. Privacy

Your use of the ATS is also subject to Recon's Applicant Privacy Policy.

The Applicant Privacy Policy explains how Recon collects, uses, shares, retains, and protects personal information submitted or generated through the recruiting and hiring process.

By using the ATS, you acknowledge that your personal information will be handled as described in the Applicant Privacy Policy and in accordance with applicable law.

11. Third-Party Service Providers

Recon uses third-party service providers to operate and support the ATS.

These providers currently include:

  • Supabase for database and data-storage infrastructure
  • Render for application hosting
  • Resend for email delivery

Your information may be processed through these services as reasonably necessary to operate the ATS and conduct Recon's recruiting and hiring activities.

Recon is not responsible for outages, interruptions, delays, or other service issues caused by third-party infrastructure providers that are outside Recon's reasonable control.

12. Availability of the ATS

Recon attempts to maintain the availability and functionality of the ATS but does not guarantee uninterrupted or error-free operation.

The ATS may occasionally be unavailable due to:

  • Maintenance
  • Software updates
  • Technical problems
  • Hosting or infrastructure issues
  • Internet or telecommunications failures
  • Security events
  • Circumstances outside Recon's reasonable control

Recon may modify, suspend, or discontinue any portion of the ATS at any time.

If you experience a technical problem that prevents you from submitting an application, you may contact Recon for assistance.

13. Intellectual Property

The ATS, including its software, design, layout, text, graphics, branding, functionality, and related materials provided by Recon, is owned by or licensed to Recon and is protected by applicable intellectual property laws.

Except for the limited right to use the ATS for its intended application purpose, nothing in these Terms grants you any ownership or other rights in the ATS.

You may not copy, reproduce, distribute, modify, create derivative works from, reverse engineer, or commercially exploit any portion of the ATS except as permitted by applicable law or with Recon's prior written authorization.

14. Feedback

If you voluntarily provide feedback, suggestions, or ideas regarding the ATS, Recon may use that feedback to improve its systems and services without obligation to compensate you.

This section does not give Recon any ownership rights in your résumé, cover letter, or other employment application materials.

15. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the ATS is provided on an “as is” and “as available” basis.

Recon does not warrant that:

  • The ATS will always be available
  • The ATS will be completely error-free
  • All technical defects will immediately be corrected
  • Submission of an application will result in consideration, an interview, or employment
  • Electronic communications will always be delivered without delay or interruption

Nothing in this section limits any right or warranty that cannot lawfully be excluded.

16. Limitation of Liability

To the fullest extent permitted by applicable law, Recon will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from your use of or inability to use the ATS.

Recon will also not be responsible for losses resulting from circumstances outside its reasonable control, including failures of Internet services, telecommunications providers, hosting providers, or other third-party infrastructure.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

17. Security

You agree not to take any action that could compromise the security or integrity of the ATS.

If you become aware of a suspected security vulnerability, unauthorized access, or other security issue involving the ATS, please report it to:

legal@reconms.com

You should not publicly disclose or exploit a suspected vulnerability in a manner that could place applicant information or Recon systems at risk.

18. Changes to Job Postings

Recon may update, correct, modify, suspend, or remove a job posting at any time.

A job posting may be closed because:

  • The position has been filled
  • Recruiting needs have changed
  • The position has been modified or canceled
  • A sufficient number of applications has been received
  • The posting contained an error
  • Other legitimate business reasons require the posting to be changed or removed

The continued display of a posting does not guarantee that the position remains available.

19. Compliance With Law

You agree to use the ATS in compliance with applicable federal, state, and local laws.

Recon administers its recruiting and hiring process in accordance with applicable employment laws and regulations.

Nothing in these Terms is intended to waive or restrict any right an applicant may have under applicable employment, discrimination, privacy, labor, or other law.

20. Changes to These Terms

Recon may update these Terms from time to time to reflect changes in:

  • The ATS
  • Recruiting practices
  • Technology
  • Service providers
  • Legal requirements
  • Security practices
  • Business operations

When these Terms are updated, the effective date at the top of the Terms will be revised.

Your use of the ATS after updated Terms are posted will be subject to the version in effect at the time of that use, except where applicable law requires additional notice or consent.

21. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent that applicable federal law or the law of another jurisdiction must apply.

Any dispute relating to these Terms or the ATS that is properly brought in court shall be subject to the jurisdiction of courts located in Texas, except where applicable law requires otherwise.

Nothing in this section limits any statutory right or legal protection that cannot lawfully be waived.

22. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.

Any invalid or unenforceable provision will be interpreted or modified only to the minimum extent necessary to make it enforceable where permitted by law.

23. Entire Terms

These Terms, together with the Applicant Privacy Policy and any other notices expressly incorporated into them, constitute the terms governing use of Recon's ATS.

These Terms do not replace or modify any separate written employment offer, employment agreement, confidentiality agreement, or other agreement that may apply if Recon offers you employment.
